Why was Angels Camp City Council so Nervous--City does not repect private property rights!!

   At the December 3, 2013 Angels Camp City Council meeting the agenda item for reconsidering the Resolution they had passed in September for Mr. Menary was again discussed.

   This time, however, City Administrator McHatten sat hanging his head most of the time and the City Attorney Derek Cole stated that he had new documents showing that the City had access to the utilities and that he hoped the two property owners would not be taking the Kirby Street issue to court.

   There were very nervous looks out into the audience where apparently quite a few people were sitting quietly watching to see what the Council would do.

   However, it was clear that this decision had been made before the meeting, and a motion was made to rescind the Resolution, seconded and it passed 5-0.

   The embarrassment to the City Council and especially the City Attorney and Administrator is obvious. They neither one did their homework and apparently had the wool pulled over their eyes by Mr. Menary back in September.

   Kirby street, avenue, lane, whatever is back to a private driveway owned by Mr. Sutton. They never had any business changing or even getting involved in the road fight caused by Mr. Menary.

   Mr. Menary has access, although not in his deed, to Kirby street through Easy Street. Mr. Sutton has deeded access from A street and it looks to us as though blocking Menary off with trailers is legal.

      This could have become very nasty for the City Council if they had kept the Resolution they themselves wrongly approved accepting Kirby street into the City streets for Mr. Menary.

   The City of Angels Camp does not respect private property rights. This was shown when they tried to run over people and improperly called in the cops when putting in new sewer lines over and over again.
