Judge Healy FORCED to recuse himself in Strohmeyer case

Neither the Strohmeyers, the
Calaveras Sheriff or anyone
else can tell any publication
what it can write. We do still
have a Constitution; at least
until Trump is our President.
   At a court hearing today for a Requested Restraining Order against Karen Strohmeyer, Judge Tim Healy had the case scheduled in his Courtroom
2 in San Andreas.

   The request was brought by Donna Broglio, the next door neighbor of the
Strohmeyers, who has documented and reported Karen Strohmeyers' repeated stalking for 5 years.

   Broglio had not received any response from Ms. Strohmeyer in the case, who is represented by a lawyer, even though the Sheriff had served her.

   After that was established and her attorney handed Broglio a copy of the response, the judge wanted to know if Broglio wanted a continuance.  What a ridiculous question! There was no time to review their response instantly!!

   Ms. Broglio explained that more extreme problems had come up with Sgt. Rogers in the Sheriff's Office telling her that in order to stop the repeated harassment, not to write about the Strohmeyers.

   This caused Ms. Broglio to file a formal county complaint for trying to block 1st Amendment rights. It also confirmed the Broglio's claim that the Sheriff was protecting the Strohmeyers from prosecution and that they agreed with the Strohmeyers.

    The Sheriff was acting as Judge, Jury and a Get out of Jail Free Card.

   Also, Broglio asked Judge Healy if he really felt he should handle this case, due to the fact that they knew each other and had personally discussed Sheriff Kuntz in regard to these people.

   Healy stated that he read the complaint and noticed the names of Kuntz and Oliveira and did remember discussing Kuntz with her, but felt he could judge without any bias.

   Ms. Broglio again reminded the Judge that their prior private discussion was in regards to the Strohmeyers being protected by the then Sheriff Kuntz.

    Mr. Strohmeyer had been fired from CHP after being turned in by a fellow officer for beating up a young Hispanic male who was handcuffed in the patrol car back seat, and then filing a false report, lying to the police.

   Sheriff Kuntz had told Broglio he felt sorry for 'Pat', that he had gone to high school with him, so he knew he was crazy back then, but he shouldn't be fired just for beating up a Hispanic kid. He said he probably deserved it.  What a great Sheriff Kuntz was, huh???

   Judge Healy finally agreed to recuse himself from the case and the case was continued until a visiting Judge could hear the case in September.

   Since this case is well documented as totally involving the Strohmeyer woman's anger over the SierraSentinel.com's reporting of them and the harassment, will it be difficult to find an unbiased judge?

   Also, the political implications involving dead Sheriff Kuntz, newly appointed DiBasilio and Supervisor Oliviera, who was a court bailiff for years will prove interesting. We understand there will be quite a few witnesses and documents.

   The two Strohmeyers attempted to get a restraining order on both Broglios nearly two years ago now, asking the court to restrain them from writing about them in the SierraSentinel.com, and asking the court to stop them from reporting crimes they witness and harassment they receive from the Strohmeyers.

   In that case, a visiting Judge ruled ANTI-SLAP on the Strohmeyers. You cannot try to take away anyones First Amendments rights to report crimes or to write in any publication. The Strohmeyers were ordered to pay the Broglio's thousands of dollars in that case.

   There is so much more to this, which will all come out when the hearing resumes. We will keep you informed.

   In the meantime, Ms. Broglio continues to live in dire fear of Ms. Strohmeyers wrath. What will happen next?

Are you trying this case in public? If you get the lady Judge from Alameda, she doesn't mess around.

As to Heeley, be happy he recused himself.
