On May 9, convicted murderer Francisco Rubio, 67, was denied release on parole and will remain in prison for now. This was his 5th time before the parole board. District Attorney Barbara Yook appeared at the hearing in Vacaville to oppose Rubio's release and argue that he still poses an unreasonable risk to public safety. The parole board ultimately agreed and denied his release for another 3 years.
Rubio is currently serving a life sentence arising out of the grizzly killing of three people at a residence under construction in Rancho Calaveras on October 31, 1986. Rubio, his ex-wife Mary rubio and acquaintance Derek Gutierrez went to the residence to steal dynamite and settle a drug debt.
When victim David Miller, 33, would not give rubio the dynamite, Rubio shot him twice in the abdoment and left him to bleed to death. Rubio then had victims Dennis Weibe, 37, and Donna Miller, 36, lay face down on the ground. Gutierrez fled the scene in fear with Mary Rubio firing a gun after him.
Rubio then executed Weibe with two shots and then Donna Miller with four shots in order to silence them. Weibe's 17 year old son and the Miller's 4 year old daughter were at the scene during the murders, but were physically unharmed by the Rubios.
Rubio was arrested within a few days of the murders after being shot during a confrontation with another individual. Rubio had dropped his gun during this confrontation and subsequent testing revealed it had been used in the Rancho Calaveras murders.
"Defendant Rubio still refuses to own up to his part in this heinous triple homocide. Three people were murdered in front of their children and until he takes responsibility for his actions, his expressions of remorse are hollow," said District Attorney Barbara Yook. "We fought to keep him locked up because we believe he still poses a danger to society. I am very pleased that we prevented his release from prison," she added.
